How Do I Get My Inheritance in California?

To get your inheritance in California, first identify the asset, your right to receive it, and who is responsible for transferring it. A bank beneficiary claim, trust distribution and probate estate follow different procedures. Request the documents and a written status update; get legal help if your share or the delay is disputed.

Being named in a will does not itself transfer a house or release a bank account. Begin with the property you are expecting to receive. Different assets from the same person can follow different routes.

Start with the asset, then the person who controls it

California's transfer process depends on how the property was owned, its type and value, and any valid beneficiary designation. A will can explain who should inherit while still leaving a court process to complete. Property held in a trust is handled under the trust's terms; a payable-on-death account or life insurance benefit may instead require a claim directly with the institution. Other property may qualify for a simplified estate procedure. Where formal probate is necessary, a court-appointed personal representative gathers assets, addresses debts and administration expenses, and seeks approval to distribute the remaining estate. California Courts describes this as a sequence of opening, administering and closing the estate. For the person waiting to inherit, the first useful question is therefore which route applies to each asset. The next is what evidence of entitlement and remaining administration work that route requires.

Ask for a clear written update

Keep the request factual. Identify yourself and the person who died, describe the share or asset you believe you are entitled to, and ask for the documents supporting the proposed distribution. A useful request asks:

Save the request, response and delivery record. A status request is not a substitute for a court filing and does not stop a deadline. If documents are being withheld, read your information rights as a beneficiary and when a trust accounting may be required.

Separate an administration delay from a dispute

A sale that has not closed or a documented tax reserve can explain a delay. Repeated silence, unexplained transfers or refusal to follow a distribution clause call for closer review. The withheld trust distribution guide addresses trustees; the probate dispute guide addresses problems with a court-appointed representative.

If your concern is that the document itself is wrong, read about trust contests or will contests. If a spouse or dependent has immediate living expenses while probate is open, a family allowance may be relevant. It is a separate remedy from collecting an ordinary beneficiary share.

When to ask an inheritance lawyer for help

Get the situation reviewed if your entitlement is disputed, property has disappeared, a trustee or executor will not explain the delay, or you have been asked to sign a release you do not understand. Bring any notice and its service date. Our California inheritance attorney guide explains the documents to gather and the questions to ask about fees.

You do not have to live in California to have an interest in a California estate. The county guide helps locate the relevant court. If you have been asked to handle the estate yourself, start with probate attorney help and the administration timeline.

A written request you can adapt

Send a short request to the trustee or personal representative and keep a dated copy. Replace the brackets yourself. This is a request for information, not a court filing, a demand establishing your entitlement, or an extension of a legal deadline.

Subject: Request for information about [name]’s trust or estate

I understand that you are handling [name]’s trust or estate. My relationship to [name] is [relationship], and I believe I may have an interest because [brief explanation].

Please confirm your role and provide the court case number, if there is one. Please provide the will or trust terms and notices I am entitled to receive, or explain what information you need to determine my entitlement.

Please explain the current administration stage, the steps remaining before a distribution can be considered, and when I can expect the next update. If you believe I am not entitled to a distribution, please explain the basis.

Thank you. Please respond to [your contact details].

Keep the response, envelopes and earlier notices together. A beneficiary’s right to trust information depends on the trust and the person’s interest. If there is an urgent hearing, a contest notice, missing property or a disputed share, seek advice promptly instead of waiting for a reply.
