Why this county, and not another

Probate Code section 7051 provides that where the decedent was domiciled in this state at the time of death, the proper county for proceedings concerning administration is the county in which the decedent was domiciled — regardless of where the decedent died. A Stanislaus County resident who dies in a hospital two counties over, or on holiday out of state, still belongs here. Where the decedent was not domiciled in California at all, section 7052 shifts the test to where property is located. Once the right court is identified, the process is the same statewide. Section 8000 lets any interested person petition for an order determining the date and place of death and for appointment of a personal representative, probate of the will, or both. Section 8400 then withholds all authority until letters actually issue.

Probate Code sections 10800 and 10810 fix compensation for ordinary services on a statewide sliding scale — four percent of the first $100,000, three percent of the next $100,000, two percent of the next $800,000 — payable to the personal representative and again to the estate’s attorney.
